Exclusion of Liability     

• Greyhound, its directors, officers, employees, servants or agents in whole or in part, shall not be liable (whether in contract or delict) in any way whatsoever for any loss, injury or damage (including but not limited to consequential or special damages or loss of profits) of whatsoever nature, and whether or not caused by the negligence (gross or otherwise) of Greyhound, its directors, officers, employees, servants or agents arising out of, incidental to, or connected in any way with the conveyance or failure to convey by Greyhound of any passenger or person, the property of any passenger or person, or any goods which are conveyed by Greyhound as unaccompanied goods, and Greyhound, its directors, officers, employees, servants or agents are hereby released from any duty of care towards such passenger or person or the consignor of such unaccompanied goods.
  
  
• The passenger or person being the consignor of any unaccompanied goods, which are conveyed or in respect of which there is failure to convey, as the case may be, hereby irrevocably waives and abandons all and any claims against Greyhound, its directors, officers, employees, servants or agents in respect of any of the matters referred to in Clause 1 above.
  
  
• The passenger or person being the consignor of any unaccompanied goods, which are conveyed or in respect of which there is a failure to convey, as the case may be, hereby indemnifies and undertakes to keep indemnified Greyhound, its directors, officers, employees, servants and agents, and holds and undertakes to hold them harmless from and against all and any claims, loss demands, liability, costs and expenses of whatsoever nature (including legal costs) which may be made or brought against the by any third party in respect of any of the matters referred to in Clause 1 above.
  
  
• The waiver referred to in Clause 1 above will be binding on the heirs, dependants, assignees, executors, trustees or other legal representatives of the passenger or person or the consignor of the unaccompanied goods, which are conveyed or in respect of which there is a failure to convey, as the case may be.
  
  
• Tickets issued by Greyhound for travel on vehicles or service to be provided by other operators will be submitted to the conditions of carriage of such other operator and Greyhound shall have no liability (whether in contract or in delict) of any nature whatsoever to any passenger or person or the consignor of any unaccompanied goods to whom such ticket is issued.
  
  
• Should Greyhound through necessity or choice employ the vehicles or services of other operators in respect of the whole or any portion of any journey to be carried out by it, then to the extent that such other operator provides or, having the obligation to provide, fails to provide any such vehicle or service, such provision or failure to provide such vehicle or service will be subject to the relevant conditions of such other operator and Greyhound shall have no liability (whether in contract or delict) of any nature whatsoever to any passenger of person or the consignor of any unaccompanied goods to whom a ticket as contemplated in Clause 1 above is issued.
